Welcome to estimio. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Service Description

estimio is a web-based planning poker tool that helps teams estimate user stories using the Planning Poker methodology. Our service includes:

• Session creation and management
• Real-time voting and consensus calculation
• Jira integration (read-only)
• AI-assisted estimation (advisory only)

2. User Accounts

Guest Users

You can use estimio as a guest without creating an account. Guest users can:

• Join existing sessions
• Vote on stories
• View results

Guest users cannot:

• Create new sessions
• Configure Jira integrations
• Access AI features
• Access historical data

Registered Users

Registered users have full access to all features, including:

• Session creation and ownership
• Jira Cloud and Server integration
• AI-assisted estimation
• Historical data and learning features
• Profile and settings management

You are responsible for maintaining the confidentiality of your account credentials.

3. Paid Pro Subscription (Future Feature)

If we introduce a paid Pro subscription tier, the following terms will apply:

• Subscription fees are billed in advance
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial billing periods
• We reserve the right to change pricing with 30 days notice

4. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated tools to abuse the service
• Share your account credentials with others
• Use the service to store or transmit malicious code
• Violate any applicable laws or regulations

5. Jira Integration

Our Jira integration is read-only. We never modify, create, or delete Jira issues. We only:

• Read issue data (titles, descriptions, acceptance criteria)
• Display Jira information in our interface
• Generate AI summaries (which are advisory only)

You are responsible for:

• Maintaining valid Jira credentials
• Ensuring you have permission to access the Jira data you connect
• Complying with your organization's Jira usage policies

6. AI Features

Our AI-assisted estimation features use Google Gemini AI. Important notes:

• AI outputs are advisory only and do not replace human judgment
• AI estimates are suggestions, not binding decisions
• We make no guarantees about AI accuracy or reliability
• AI features require a valid API key and may be subject to rate limits
• You can disable AI features in your profile settings

7. Third-Party Services

estimio uses the following third-party services:

• Google Cloud Run: Hosting and infrastructure
• Neon/PostgreSQL: Database services
• Google Gemini AI: AI estimation and summarization
• Jira (Atlassian): Issue tracking integration
• Email providers: For account verification and password reset

We are not responsible for the availability or performance of these third-party services.

8. Service Availability

We strive to provide reliable service, but we do not guarantee:

• 100% uptime or availability
• Uninterrupted access to the service
• That the service will be error-free
• That data will never be lost

We may perform maintenance that temporarily interrupts service. We will make reasonable efforts to notify users of planned maintenance.

9. Account Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• You fail to pay subscription fees (if applicable)
• We discontinue the service

You may delete your account at any time through your profile settings. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

10. Intellectual Property

All content, features, and functionality of estimio are owned by us or our licensors. You may not:

• Copy, modify, or distribute our service
• Reverse engineer or attempt to extract source code
• Use our trademarks or branding without permission

11. Limitation of Liability

To the maximum extent permitted by law:

• We provide the service "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months (if applicable)
• We are not responsible for decisions made based on AI suggestions

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by:

• Posting a notice on our website
• Sending an email to registered users
• Updating the "Last Updated" date

Continued use of the service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms of Service are governed by the laws of Switzerland. Any disputes will be resolved in the courts of Switzerland.
